2. Our Services

ArtsToBe is an online platform based in Vadodara, Gujarat, India. All products are created, owned, and sold directly by ArtsToBe.

3. Eligibility

You must be at least 18 years old to make a purchase. Users under 18 may use ArtsToBe only with parent/guardian involvement.

4. Buyer Terms

• Purchases are subject to availability and payment confirmation.
• Prices are in INR for Indian buyers, including GST if applicable.
• International buyers bear customs, import duties, or other applicable taxes.
• Provide accurate delivery details; ArtsToBe is not liable for failed deliveries due to incorrect information.
• Refunds, returns, and cancellations are governed by our Refund & Return Policy.

5. Intellectual Property

All artworks, designs, logos, images, and content are the exclusive property of ArtsToBe, protected under Indian copyright and trademark law. Purchasing a product does not grant rights to copy, reproduce, resell, distribute, or commercially exploit our designs or artworks. Unauthorized commercial use may result in legal action.

6. Prohibited Use

ou agree not to use ArtsToBe for any unlawful purposes under Indian law. You must not copy, reproduce, resell, or distribute products for commercial purposes. You must not attempt to disrupt, damage, or interfere with the website. Any violation of these terms—including unauthorized commercial use, redistribution of products, reshare without permission, or any use other than personal use for products purchased from ArtsToBe—may result in civil or criminal penalties. ArtsToBe reserves the right to recover any losses, damages, costs, or additional penalties resulting from such illegal use, including but not limited to the value of the products, can recover any value of penalty  in Indian Rupees (INR).

7. Limitation of Liability

All products are provided “as is.” ArtsToBe shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services.

8. Indemnity

You agree to indemnify and hold harmless ArtsToBe, its owners, and employees against claims, damages, or expenses resulting from your misuse of services or violation of these Terms.

9. Dispute Resolution and Governing Law

These Terms are governed by Indian law. Disputes are subject to exclusive jurisdiction of courts in Vadodara, Gujarat.

10. Termination

We may suspend or terminate your access if you violate these Terms.

11. Future Seller and Artist Rules (Reserved)

• Ownership of Content: Sellers retain rights but grant ArtsToBe a license to display/promote work.
• Responsibility: Sellers are responsible for product quality, legality, and customer service.
• Compliance: Sellers must follow Indian consumer protection, GST, and IP laws.
• Dispute Handling: ArtsToBe may mediate, but final responsibility lies with the seller.

12. Changes to Terms

We may update these Terms from time to time. Continued use constitutes acceptance of updated Terms.

13. Harassment, Abuse, and Misuse

Harassment, abusive language, threats, stalking, or discrimination towards ArtsToBe or staff is prohibited. Serious violations may be reported under the IT Act, 2000 and IPC sections (e.g., 354A, 354D, 499, 503, 507). Do not send spam, offensive messages, or attempt to bypass official transactions.
